Rumor: Britney says no go to financial custody settlement and prepares for battle

Update:
Life & Style
is now reporting that the couple have settled their custody battle, granting Britney full legal and physical custody of their two young sons. A rep for Britney says the settlement isn’t final but will be in a few weeks.

Britney reportedly heard the news from her lawyer in the middle of the January and immediately called her big brother, Bryan Spears, exclaiming "It’s over Bry," a friend of the pop star says.

"Brit thinks she and Kevin have really turned a corner, and she wants him to see the kids as much as he needs to," Brit’s friend says.  "Her biggest hope is that they can bury their difference fro the sake of the boys.

Kevin was given full visitation rights, $7 million, which will come from the sale of the couple’s Malibu mansion, and about $500,000 in cash. According to their prenup, Kevin is also allowed to keep any gift Britney gave him under $10,000, like jewelry and clothes, but he must return his beloved Ferrari and motorcycle.

Britney’s friend says Kevin feels the settlement is fair and that "he told Britney he’s happy with the arrangement. He knows it’s best for the kids not to get into an ugly custody battle."

According to Life & Style, Britney Spears is no longer allowing her estranged hubby Kevin Federline to call the shots. Previous reports state that Kevin offered to drop his suit for custody of the couple’s two sons, 16-month-old Sean Preston and 4-month-old Jayden James, if Britney would give him a substantial financial settlement.  Right now the couple share joint custody.

However, sources say that although the pop princess was initially an emotional wreck, afraid of losing her sons, and that she had planned to give into Kevin’s demands, she is no longer playing nice. An insider says that Britney received a pep talk from her mom, Lynne Spears, and her manager Larry Rudolph , and they convinced her that she is right and that the law is on her side.

"Britney’s outraged at Kevin’s brazenness," the insider says.  "She believes that righteousness is on her side and no judge would award Kevin full custody. She told her lawyers ‘He’ll get that money over my dead body.’ She’s prepared to got to the mat. She’s going to fight."

you go britney!! i think its pretty low that a man would trade the chance to have his children for money what a jerk! britney girl shape up get it together and fight for those babies and fight for your money after all you earned it not the jerk you married right!

  2. Lorus Says:

After the way she’s been behaving I wouldn’t be surprized if they get joint custody. Since the boys are still young this could mean that they live with Kevin part of the time.

  3. lanie Says:

i have to say, lately? Kevin’s been the better parent.

  4. Vanessa lane Says:

Britney better clean her act up when she fights Kevin tooth and nail in court. Her partying could spell disaster for her. But then again, what judge in his/her right mind would grant custody to a douchebag like Kevin Federline?

  5. annabelle Says:

Most custody battles get yucky — but I can’t even imagine how this one is going to play out. Seems that BOTH parents have some growing up to do — and cleaning up — to settle down and be good parents to their boys. Difficult situation all the way around. JMO.

  6. alexa Says:

So basically his children are worth a certain amount of money to him?

Or just giving up on sole custody

  7. corinne Says:

Surely she needs to clean up her act.
It’s not looking good if they go to court.

  8. Heavenly_hibiscus Says:

Well, good on her for standing up for herself.

I feel sorry for SP & Jayden :-/

  9. Aleah Says:

Whether this turns out true or not, I’m feeling very sorry for Sean Preston and Jayden James, being in the middle of their parents’ nasty divorce. Thankfully they’re very young and they won’t remember much of their fighting.

  10. tink1217 Says:

i would say Brit needs to pay extra attention to both the kids and to not be out partying so much for awhile. As long as the kids are well taken care of, not abused in any way, and Brit isn’t considered a danger to them she will get custody. Look a KFed’s track record! Is CA a no fault divorce state? Florida is. It doesn’t matter why a couple divorces, adultery, drugs, etc.. None of that can even be mentioned. It is of no bearing on the outcome at all. And, as far as custody goes, here in Florida you have to prove the mother unfit, which is VERY hard! You basically have to be a crack whore living on the streets for a mother to NOT get custody. Good luck Britney! I am really pulling for you to come out fo this in tact!

  11. JEH Says:

I certainly agree that Kevin may not be awarded full custody, however if she plans on a fight, its exactly what she will have given what we have seen of her behavior and actions recently.

  12. Michelle Says:

How sad that money means more to him than his sons

  13. Jeanine Says:

So sad that Kevin has stooped so low. I am not sure at this point who I think is more suitable to raise those children. I have a 3 year old and a 3 1/2 month old and I wouldnt give ANYTHING to have someone else raise my kids to go out and party night after night. Kids grow up so fast, Britney is really going to regret missing all these times in their lives.

As of right now, I do wish Britney gets custody but I hope she smartens up as well and stays home with her babies.

  14. Diana Says:

I am not a big fan of Britney, but GOOD for her! Yeah Britney has been out partying, but how many pictures have we seen in the past of Kevin partying. I don’t know how any one of us could make a judgment of who the better parent has been.

  15. tink1217 Says:

and when i said custody I mean “physical custody”. Of course Kevin will have as much visitation as he wants probably.

  16. cassopolis Says:

I guess no judge with keep away her child cause she’s famous. In my country (France) when you get divorce both parents shared custody; i think I’ll never get why your law permitted for a mother to have all custody ?

  17. Kelley Says:

If she gets custody is she actually going to spend time with her kids? That would be a novel idea.

  18. Megan Says:

Why don’t they just give the nannies custody and get it over with?

  19. Mary-Helen Says:

I don’t believe this for a second. Every other magazine on Earth has Kevin demanding drug tests for Britney and wanting his children desperately. Life & Style actually had an article a couple of weeks back where he wanted Jayden tested for alcohol because he was under the impression Britney was nursing. This is just another attempt by “Camp Britney” to make Kevin look bad, which is sad because it shouldn’t be hard to make Kevin look bad. She is just ticked that people took Kevin’s side because of her hard partying and neglectful behaviour.

  20. tink1217 Says:

if its true, which i hope it is, then at least they are doing the best thing by their boys by not dragging it out in a long court battle. time to grow up and take care of those babies! lots of luck to Brit!

  21. Erin Says:

I have never thought Kevin was a bad father. All this negative press is stupid and, if this update is true, then at least someone in this thing doesn’t want to make the kids suffer with a long custody battle.

  22. Jess Says:

Good thing that is over (or will be over). it’s a shame [Kevin] will be getting away with so much money, but money isn’t what matters, it the kids. Hopefully Britney will shape up and be a good parent.

  23. Heavenly_hibiscus Says:

WOW $7mil sounds awfully nice. No doubt Fedex is going to have gold diggers after him now! Given he’s quite fertile I wonder how many half siblings SP & Jayden are going to end up with?

  24. Heavenly_hibiscus Says:

Shar should demand more child support too!

  25. ang Says:

god what a mess. i hope whoever ends up with the kids will be the best person for them.

  26. Marie Says:

I’ll say just this — regardless of whoever “wins”… the kids still lose.

  27. mel Says:

Britney hasn’t been out partying for a long time, so I don’t know why people keep bringing up that. Yes, she wasn’t doing the best thing in the world, but she seems over it now.

As for Kevin wanting drug testing – bull! Plain and simple. If he thought the kids were in danger he could get emergency custody of the children.

As for Kevin being a good father…well he’s barely a father at all to the first children he had. I know Britney gets bashed for going out, but again Kevin does the exact same thing night after night. At least Britney has calmed down and is now spending her time being a mother and working. Britney going out for a month does not negate her nearly 2 years spent being primary caretaker of her children while Kevin went out.

  28. Angie Says:

Britney should just give Kfed custody of the boys so she could continue to live her life as if she doesn’t have kids. She could party all she wants, sleep around, do whatever, adn just visit her kids a few days of the week. I think she wants it that way, but is having a hard time giving up her control in the situation.
